New York Tourists Sue Broadway Show For Injuries From Prop Mishap

Posted on Feb 22, 2011

Two women who were visiting New York City from Kansas City are suing a Broadway theater company for $2 million each after they suffered serious injuries while watching a musical.

The women, 54-year-old Elaine Rosen and 60-year-old Cynthia Noblit, were sitting in the front row of the Imperial Theater on Broadway in Manhattan and watching Billy Elliot: The Musical when a prop flew off of the stage and into the audience. The women’s personal injury attorney said that the injury took place during the dance number at the end of the first act and that the women were escorted out of the theater and taken to the hospital immediately. They believe that the women were hit by a plastic box or crate that was either kicked off of the stage or that slipped out of the hands of one of the performers.

Rosen suffered a gash on her face that required stitches and now has a permanent scar. Noblit suffered a concussion, though she didn’t lose consciousness, and underwent an MRI and CT scan. The women were offered tickets to see the musical again in the future and the theater company changed the choreography to prevent a similar accident from occurring in the future.

The women are suing the musical’s producers, Billy Broadway and NBC Universal, saying that the front rows of the audience should have been warned of potential danger and that the dance number should have been recognized as dangerous and hazardous.
