

Northern Westchester Hospital has filed an appeal regarding a 2006 New York birth injury medical malpractice decision. The hospital was asked to pay $56 million in damages because of their negligent delivery of a baby boy in 2003 that lead to permanent injury and lifelong disability.
The White Plains birth injury lawsuit was originally filed in April 2006, by parents Bruce and Mary Swanson against Women's Medical Associates and Dr. Carla Eng-Kohn. The Swansons put forth that the hospital staff and doctor were negligent in the birth and delivery of their son. During the birth, the hospital medical staff discovered that they boy had shoulder dystocia and was trapped in the birth canal. By the time the baby was finally delivered, he had suffered permanent birth injuries, including brain stem damage, facial bruising, arm bruising, nerve damage, and internal bleeding. The Swansons believe that the hospital staff did not respond to the shoulder dystocia in a timely manner and that a more reasonable response to the complication would have prevented the harm to their newborn.
The injuries the baby sustained during the birth process have caused developmental delays, speech issues, and aspiration pneumonitis. Last year, a White Plains jury listened to the facts of the NY medical malpractice case and awarded the Swansons $56 million in damages.
Northern Westchester Hospital released a statement regarding the White Plains medical malpractice appeal, saying that their sympathies go out to the Swanson family, but they believe that their hospital staff performed appropriately and that there is not significant evidence otherwise.
